He gave us a quote and explained the situation, so we were ready to make a decision after the call. His retaining fee was fair, and his staff was extremely helpful and professional. In our court Zoom call, he was extremely professional, succinct, and had the judge’s respect. That was impressive, and we are on our way to a quick resolution to our situation. Our San Antonio Family Law Lawyers Have the Family Law Expertise You Need

The Amsberry Law Firm has been in practice for more than 25 years. Trust our team to use our years of expertise to your benefit. Our San Antonio family lawyer focuses on family law, as well as on employment law, estate planning, and probate needs. We go the distance for our clients, always working to try to achieve results that our clients may not have even thought possible.

Hiring our San Antonio family lawyer can help you navigate many types of legal situations related to family law in which we have expertise, including the following.

Divorce

Even when you and your spouse are in agreement about most legal aspects of the divorce, hiring our team will help you follow all the state’s rules regarding divorce. On the flip side, when issues such as child custody, visitation, child support, division of assets and debts, and alimony are in dispute, our divorce attorney is ready to help with negotiations. We also can help with issues unique to divorce for military members stationed stateside or during deployment.

Child Custody and Visitation

Each family’s needs for custody and visitation rights are unique, and we tailor our representation to fit those needs. Our San Antonio child custody lawyer can help you develop a Parenting Time Schedule that follows requirements in Texas law. We will use the facts in the case to argue for the most favorable and stable situation for the children. And if disagreements regarding visitation schedules arise, our child visitation attorney has the skills necessary to help work through the problems and to deliver the best possible outcome for you and the kids.

Paternity

We understand the emotion involved in a paternity case. We give our clients the support they need to seek custody and visitation, regardless of whether the parents are unmarried, divorced, or separated.

Child Support

Financial support for the children in a separation or divorce is important to meet their needs. But the financial support arrangement must meet your needs, too. We will fight to make sure our clients receive the fairest treatment possible.

Alimony and Spousal Support

If you stopped working to care for the children prior to the divorce, the proper spousal support arrangement can help you financially. This gives you time to work toward gaining skills to rejoin the workforce. We will argue for the alimony payment you deserve. It can be difficult to understand exactly how to calculate alimony in Texas. Our San Antonio family lawyer will walk you through the calculations to make sure that you receive the fairest treatment possible, whether you are receiving or paying alimony.

Property Division

Property division after a divorce can be a complex process, depending upon when you and your spouse acquired the property. Our San Antonio family attorneys are ready to help you navigate these complexities, working toward the best possible outcome.

Domestic Violence

When your spouse engaged in violence against you or the children, the divorce hearings must consider this type of abuse. On the flip side, we will vehemently defend the rights of our client who was the target of false allegations of abuse. We will work tirelessly to achieve a solution that protects you and your children. And should you believe you are the victim of parental alienation, our San Antonio family lawyer can help. Although parental alienation does not specifically qualify as domestic violence, it is something the court will take into consideration when discussing things like child custody and visitation rights.

Adoption

Our family law lawyers in San Antonio provide advice and legal help on all types of adoption proceedings, including those involving private adoptions, agency adoptions, stepparent adoptions, and adoptions by relatives.

Post-Divorce Modification and Enforcement

Your life and that of your spouse may undergo significant changes after the initial divorce settlement agreement. These changes may necessitate an adjustment to the settlement. If so, our team is ready to help you take the necessary steps to seek a new, fair settlement.

Prenuptial and Postnuptial Agreements

No one wants to think about divorce at the time of an engagement or wedding. However, a prenuptial or postnuptial agreement can protect everyone involved, including children, in case a divorce does happen.

Grandparent Rights

A divorce and determination of child custody and visitation is difficult on everyone in the family, including grandparents. Unfortunately, grandparents do not have many rights regarding their relationships with the kids after a divorce. However, in some cases, a judge may determine that the children are safer with the grandparents. Alternatively, if your child who is the parent passes away or has his or her parental rights terminated for whatever reason, you as the grandparent may still have an opportunity to seek court ordered periods of visitation. We can help you with this type of case.

Let Our San Antonio Family Lawyer Help You Minimize Instability

When a family undergoes an event that requires hiring our San Antonio family law lawyers, instability for the family likely is also occurring, unfortunately. Adults who need to file a family law case often are in a situation where life is upended for both them and their children. This is extremely hard on everyone in the family, but it is especially difficult for children. As a parent, even though you understand that a divorce is necessary, you hate to see your children lose the home life they’ve known to this point.

Our team knows how frustrating it can be for clients to work through a family law case. We will provide you with compassionate service, always keeping the well-being of the children in mind. We want to help you achieve the best possible outcome in the shortest amount of time, so you can return to a sense of normalcy.

FAQs: Common Questions for Our San Antonio Family Lawyer

Throughout our multiple decades of helping clients, we always have taken pride in our ability and willingness to take the time to answer any questions our clients have. We do not avoid your calls after you choose to hire us, like some firms might do. We make ourselves available for you through the communication method you prefer, so you always feel like you know what is happening with your case. To allow you to gain a feel for how our San Antonio family lawyer handles these kinds of cases, here are some of the most common questions our clients have for us.

Does Texas allow legal separations?

No, Texas does not have family law statutes that deal with legal separation, only divorce. After physically separating, if you need to obtain some rulings for the children and for dealing with your spouse, Texas does allow for temporary orders that handle the situation until the divorce finalizes. However, if you are a member of the armed forces, you will be required to pay an allotment to your spouse while you are separated and while your divorce is pending.

Who pays the family law attorney legal fees?

The majority of the time, the parties involved in the case will all pay their own family law attorney legal fees. Even in a divorce, it is rare for the court to order one spouse to pay the legal fees for the other spouse. Exceptions to this are in the area of enforcement actions, where the Texas Family Code clearly states that a court, upon finding that a party is in contempt, must award reasonable attorney’s fees. Further, in a situation where the earning capacities between the divorcing parties is significantly different or where there are children involved, the court may award interim attorney’s fees to the party who is able to establish a need for representation but is unable to afford it.

How does a court decide on alimony?

In the case of a divorce, the court may award one spouse an alimony payment from the other spouse; this is also called “spousal support.” This is separate from child support, which should help with the expenses of being the primary caregiver for the children. Alimony helps one spouse with living expenses if he or she has health problems or relied financially on the other spouse during the marriage. We can help you argue for a fair amount to be awarded for alimony or, conversely, to avoid having to pay any spousal support, as long as the facts support it. Alimony is a tricky aspect of divorce, but you can be certain we will tackle any issues related to it head on.

What is joint custody?

When the court attempts to assign custody of children after a divorce, it will first try to award joint custody. This means both parents have a right to provide input on major decisions about the children’s lives. It does not, however, mean the children will spend the same amount of time with both parents.

What is equal possession?

In some divorce cases involving children, by agreement of the two divorcing parties or through a court order, the court can enter an equal possession order. This gives both parents 50/50 child custody and visitation. In these instances, however, child support still may occur. Unless both parents have an equal income, the court will typically order the parent making more in income to pay some amount of child support.

Do I need to hire a San Antonio family attorney for adoption?

Some adoption processes are straightforward, while others have quite a few complexities. These can include instances of not having any good contact for the biological father, opposition to a termination, or other factors making an adoption more difficult. Courts routinely require an adoption social study and background check as part of any adoption evaluation before granting an adoption. We have experts and resources we can pull together on your behalf, which are not readily available without legal representation. When you have concerns about your legal rights as part of the adoption, hiring our San Antonio family attorney is a good idea. You do not want legal problems to arise down the road in a case like this, as such problems could place the legality of the adoption in jeopardy.

Can San Antonio family law lawyers help if my spouse cheated on me?

In Texas, you have the ability to file for divorce with adultery as the primary reason for your spouse being at fault. If we decide to file for this reason, our San Antonio family law lawyers will work to show the judge how the adultery harmed you. The judge then may choose to take the adultery into consideration when making rulings about the divorce, giving you the chance at receiving more favorable outcomes.

We never want our clients to feel as if their family law situation is moving forward without their input. We work hard to keep our clients informed at every step of the process. Answering questions in a timely manner as they arise is a big part of the service that we provide.

Our San Antonio Family Attorney Will Fight Hard Toward a Successful Outcome

Rest assured that we will not sacrifice the outcome in the case just to settle it faster. We always balance the desire for a fast resolution with the need to help you receive the best possible outcome for you and your children.

We keep our clients up to date on the case regularly. When questions arise, we are here to provide answers and advice. When you have the information you need to make informed choices, the case moves along faster, too.
